If the Devils re-acquired Kovalchuk, would they still have to pay the recapture fee from so many years ago?

Well the Kings are expected to terminate Kovalchuks' contract within a couple days so why trade for him. Wouldn't want his 35+ contract at a cap hit of 6.25M. Imagine Kovalchuk doesn't want to play for the Devils, leaves the team and the Devils are stuck with the cap hit
