The team that eventually trades for Eichel will have to agree on the surgery he wants. This also is the reason why this trade process is taking a long time because I don’t think a lot of teams would be comfortable with the disc replacement.

Eichel's value is probably around the Montreal and Ottawa offers right now. Maybe the Rangers. The rest aren't happening.

The longer his injury goes untreated and he doesn't play, the less he'll return. The only way he gets his value back is by getting surgery and showing he can still perform at a high level.

Buffalo needed to make things happen early in the off season. They failed. Now they almost have to keep him until he's fully recovered his value.

Jack Eichel as a professional hockey player is property of the Buffalo Sabres.

He signed a contract to play for them.

By refusing to play for the Sabres by not getting the medical treatment prescribed by the team, he appears to be violating that contract IMO.



If there's a part of the CBA that says a player under contract must seek the medical treatment prescribed by the team before returning to play, then the Buffalo Sabres have a legitimate beef in this matter.

However, if the CBA says the player gets to decide on the medical treatment, then that would be a different story.

I think this could end up in a court of law, as Elliotte Friedman alluded to.

Disagree with part 1 - Drouin until he plays and plays an extended amount doesn’t have any real value

Agree with everything else, BUF has somehow literally made the situation worse almost daily.

Did they though? All i can say is that an offer wasnt made that the sabres accepted. Its possible that every offer was just a lowball offer. Pretty sure i just saw that one of the teams was adamantly against the adr procedure, which could very well be reason adams is holding the line. Even with negotiations becoming contentious, does anybody believe that adams gives one hot shot about which surgery he gets?

Anaheim trade isnt at all realistic without protection and/or multiple conditions on those picks

It is impossible for Minnesota to fit Eichel under the cap without major roster changes and like the ANA one there needs to be conditions

Habs trade as others have said is clearly not in the same realm as the others

Rangers trade is counterproductive, so not at all realistic

Vegas trade still leaves them like 6M over the ceiling

IIRC, the club physician recommends the final course of treatment. The player may get a 2nd opinion, and if they can't reach a consensus, a third physician is brought in to help resolve the dispute.
The problem is that it is still the club's physician who makes the final call (but they must give proper consideration to the recommendations of the other physicians, whatever that means).
We have to assume that has already happened and it changed nothing.

Then there are avenues involving the league, NHLPA, and arbitrators, specifically to avoid these situations from ending up in courts. Including grievances.
Physician-patient relationship is supposed to trump their obligation to the club. I'm not convinced that is happening here, and if Eichel is similarly unconvinced, he has a case for a grievance as well.

This all has to happen before we can even get to the possibility of addressing the basic right of a player/patient being able to decide on their own course of treatment.
Not something the NHL wants, as it undermines their own system for clubs being able to exert control over their players as "property" and could potentially leak into other areas of their control being scrutinized.

That's why I find it so strange that Buffalo is being so stubborn (and the league is allowing it, though their reluctance to interfere in a club's autonomy is understandable).
IF it does go to court some reason, I can't see it going any other way than with Eichel winning and the league being forced to make changes to the CBA.

Excellent points, it just appears to me as an outsider who isn’t a fan that obviously doesn’t have any knowledge of situation that Sabres are being obstinate and petty in stripping him of the captaincy.

Stop and ask why Eichel has not elected for medical arbitration. Could be because he knows he would lose the case and either be forced into the allegedly less risky surgery or, maybe he'd have to compromise his contract and risk $50M guarantee (which the NHLPA would not allow).
Possibly insurance will not cover $50M against ADR, but will cover fusion.
The team would risk losing an asset with no possibility of compensation in trade or draft picks and could be forced to pay his guaranteed salary.
Far more complex than "just let him get the surgery he wants" I've seen people suggest.

There is a pretty heavy dose of spin to anything you read about this. As a sabres fan, i just want adams to return something good for eichel. A poor return is an epic fail (i dont care if its in any way different, the ror trade is an all too recent reminder of what happens when you get crushed in a trade because you decided to take whatever the best offer was), a decent return starts a rebuild properly, with a likely top 3 pick in a very good draft class. And since the trade hasnt happened, its all just potential, potentially bad and potentially good.

It's definitely more complex.
I'm only saying there's no way Eichel can be forced into the procedure Buffalo wants. He might "concede" and do it, but he doesn't "have to".
He has options. That includes going to the KHL, leaving Buffalo with only his rights. Buffalo's options however, are running out.

Going to the KHL is not an option because he has a standing contract with the NHL. It’s not like he is an RFA or UFA and could decide to sign in the other league. The NHL and KHL have a handshake agreement about not poaching each other’s players when they have an existing contract. Breaking that agreement could mean the end of the KHL because NHL teams could take whatever player they want from Russia as long as they are willing to sign. The NHL would never be as harmed as the smaller league.

It's an option if he doesn't have a contract. He's not going to sit in limbo forever. He can retire from the NHL if he's determined to get healthy and play without Buffalo impeding him. That's probably his last card though.

He could go get surgery tomorrow and what are Buffalo's options? Suspend/fine him or terminate his contract?

@sabres89 @Tjm220 No one really knows what is happening. For all we know there a multiple offers that need small adjustments or involve a third team.
@Xqb15a So taking the "C" away from a player who says he does not want to play for the team is a petty move on the Sabres?
The Sabres have made some questionable moves but removing the "C" and giving it to a actually team member is the right thing to do.
Taking the "C" and "A" from Thornton and Marleau was "petty".

Even if he were to retire the Sabres would retain his rights because he had an existing contract at the time of retirement. If he “retired“ and tried to come back one season later the Sabres would have the immediate right to reclaim him and there’s nothing he can do about it. If Jack were to get the surgery he wants without the teams permission, for one thing he’s paying for it himself. In addition he would be in violation of the CBA, and the Sabres could probably sue him for breach of contract rather than terminate his contract and then lose him for nothing. Contrary to popular opinion the Sabres have done nothing that is not within their rights according to the CBA. Jack has not filed a grievance with the NHLPA because he has no reason to, and everyone knows he would lose. I’m curious if the end of this situation leads to discussion about changing the CBA to give players more control over the medical procedures they receive.

Making a big announcement over it in the off season definitely has a petty feel about it, I’m just telling you how it appears to me a non fan of the situation.
