Yep, the Leafs can do. But then they have to fill Marleau spot with a player, so the cap saving is just 300,000. Being a NMC, Marleau doesn't have to report to the Marlies and he will still get paid.

Well the threat of life as a Marlie (or healthy scratch) might force Marleau to agree to a trade, which would create 5 million more to spend (hello Top 4 Dmen). The Leafs have a lot of above average D prospects (Rosen, Bergman, Sandin, Lilly, Rasanen, Hollowell, Gordeev and Kral) to add to the cash dump of Marleau's contract.

The Leafs cannot assign him to the Marlies without Marleau's permission. The only threat they have is to healthy scratch him which would be a horrible morale move for pretty much every young player who looks up to Marleau. Not really a smart move.

The only hope the Leafs have of ridding themselves of that contract is if Marleau decides to retire at which point the Leafs can move him to a cap floor team, Marleau retires, then signs a 1 day contract in San Jose to retire a shark.

The other but possibly illegal way is to move his contract after July 1st (after his $3M bonus is paid) to a team looking to hit the cap floor and add another asset, buy out Marleau (to do this they must have a player scheduled for salary arbitration which gives the team a 2nd buyout window) then the Leafs can re-sign Marleau to a 1 year $1-2M similar to the way Orpik was done. Problem here is the league may be able to prove better a case for cap circumvention.

But there is NO threat as a Marlie, NMC Marleau doesn't have to report. And what trade? A good team, a Cup contender who Marleau might agree to go to, almost likely doesn't have the cap or the desire to have Marleau on their roster any more than the Leafs do. Then NMC Marleau likely doesn't want to move and play for a non contender either.
The prospect of being a healthy scratch might be quite real, but it really doesn't move Marleau off the Leafs roster either.

the name in NMC stands for movement. sending him to the AHL is movement. Marleau can, and would say no to going to the AHL. Moving on.
